Notifications of any claimed copyright infringement should be sent to Life At The Villages via email to Support@LifeAtTheVillages.com. The procedure for this is as follows and to be effective, the Notification must include the following:
1 An electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
2 Identification of the copyrighted work or trademark claimed to have been infringed, or if multiple copyrighted works or trademarks are covered by a single notification, a representative list of such works or trademarks;
3 Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Life At The Villages to locate the material;
4 Information reasonably sufficient to permit Life At The Villages to contact the Complaining Party, such as an address, telephone number, and if available, an electronic mail address at which the complaining party may be contacted;
5 A statement that the Complaining Party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, trademark owner, its agent or the law; and
6 A statement that the information in the notification is accurate and, under penalty of perjury, that the Complaining Party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Upon receipt of the written Notification containing the information as outlined in 1 through 6 above:
Life At The Villages shall remove or disable access to the material that is alleged to be infringing;
Life At The Villages shall take reasonable steps to promptly notify the Complaining Party that it has removed or disabled access to the material.
LINKS WITHIN THE LIFE AT THE VILLAGES WEB SITE MAY LET YOU LEAVE THE LIFE AT THE VILLAGES WEB SITE. THE LINKED SITES ARE NOT UNDER THE CONTROL OF LIFE AT THE VILLAGES AND LIFE AT THE VILLAGES IS NOT RESPONSIBLE FOR THE CONTENTS OF ANY LINKED SITE. LIFE AT THE VILLAGES IS PROVIDING THESE LINKS TO YOU ONLY AS A CONVENIENCE, AND THE INCLUSION OF ANY LINK DOES NOT IMPLY ANY ENDORSEMENT BY LIFE AT THE VILLAGES.
By using the Life At The Villages web site, you agree that the laws of the State of California, without regard to the conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and Life At The Villages or their associates.
ANY CLAIM, DISPUTE, OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PREEXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, COMMON LAW, INTENTIONAL TORT AND EQUITABLE CLAIMS) BETWEEN LIFE AT THE VILLAGES, their agents, employees, principals, successors, assigns, affiliates arising from or relating to this Agreement, its interpretation, or the breach, termination or validity thereof, the relationships which result from this Agreement (including, to the full extent permitted by applicable law, relationships with third parties who are not signatories to this Agreement), Life At The Villages's advertising, or any related purchase SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ADMINISTERED BY THE NATIONAL ARBITRATION FORUM (NAF) under its Code of Procedure then in effect. The arbitration will be limited solely to the dispute or controversy between customer and Life At The Villages. NEITHER CUSTOMER NOR LIFE AT THE VILLAGES SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CUSTOMERS OR ARBITRATE ANY CLAIM AS A REPRESENTATIVE OR CLASS ACTION. This transaction involves interstate commerce, and this provision shall be governed by the Federal Arbitration Act 9 U.S.C. sec. 1-16 (FAA). Any award of the arbitrator(s) shall be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction. Life At The Villages will be responsible for paying any arbitration filing fees and fees required to obtain a hearing to the extent such fees exceed the amount of the filing fee for initiating a claim in the court of general jurisdiction where you reside. Each party shall pay for its own costs and lawyers' fees, if any. However, if any party prevails on a statutory claim that affords the prevailing party lawyers' fees, or if there is a written agreement providing for fees, the Arbitrator may award reasonable fees to the prevailing party, under the standards provided by law.

If any of these conditions shall be deemed invalid, void or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of the remaining condition or conditions.
The section headings used herein are for convenience of reference only and do not form a part of these Terms of Use and no construction or inference shall be derived therefrom.
